By creating an account on YardCrawl, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
You must be at least 18 years old to create an account or list a sale on YardCrawl.
You are responsible for maintaining the accuracy of your account information and the security of your password. You are responsible for all activity under your account.
YardCrawl is a platform that connects yard sale sellers and buyers. SAUERAPPLE LLC is not a party to any transaction between users. All transactions occur directly between users and are at their own risk.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
YardCrawl uses artificial intelligence (currently powered by Anthropic Claude) to analyze photos you upload and generate suggested item descriptions, prices, and categories. You are interacting with an AI system when using this feature. AI-generated suggestions are provided for convenience only and may contain errors, inaccuracies, or biases. The platform makes no warranties regarding the accuracy, completeness, or appropriateness of AI-generated content. Sellers are solely responsible for reviewing, editing, and approving all listing information before publishing. By publishing a listing, the seller assumes full responsibility for its content regardless of whether AI assistance was used.
You retain ownership of all content you create on YardCrawl. By posting content, you grant SAUERAPPLE LLC a non-exclusive, worldwide, royalty-free, sublicensable license to display, reproduce, and distribute your content solely for operating the platform (including hosting, caching, and delivering content through third-party infrastructure). This license terminates when your content is deleted. You represent and warrant that you own or have the necessary rights to all content you post, and that your content does not infringe any third party's intellectual property or other rights. Your content will not be used to train AI models.
You may not list the following items on YardCrawl:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR DAMAGES ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR VIOLATIONS OF LAW, SAUERAPPLE LLC'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). IN NO EVENT SHALL SAUERAPPLE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EXCEPT WHERE PROHIBITED BY LAW.
You agree to indemnify and hold harmless SAUERAPPLE LLC from any claims, damages, or expenses arising from your use of the platform, your listings, or your transactions with other users.
Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration may be conducted remotely by video or phone, or in person in San Bernardino County, California.
Class action waiver: You waive the right to participate in class action lawsuits or class-wide arbitration.
Opt-out: New users may opt out of arbitration within 30 days of account creation by sending written notice to legal@sauerapple.com or by mail to SAUERAPPLE LLC, PO Box 1222, Sugarloaf, CA 92386. The notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.
Fees: For claims under $10,000, SAUERAPPLE LLC will pay all AAA filing and arbitrator fees. For claims over $10,000, fees are allocated per AAA Consumer Arbitration Rules.
Exceptions: Small claims court actions are exempt from this provision. Either party may seek injunctive relief in any court of competent jurisdiction.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions.
In accordance with federal law (TAKE IT DOWN Act), YardCrawl provides a process for reporting non-consensual intimate visual depictions, including AI-generated images. Upon receiving a valid report, we will investigate and remove the material within 48 hours and make reasonable efforts to remove duplicates. To submit a report, contact legal@sauerapple.com or use the report button on any listing. False reports submitted in bad faith may result in account termination.
SAUERAPPLE LLC reserves the right to suspend or terminate your account at any time for violations of these Terms or our Community Guidelines.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
